Viability of a Psychiatric Injury Claim by Bystanders Who Witnessed and Rescuers Who Attended the Sea World Helicopter Accident

Abstract

This paper considers the law relating to recovery for psychiatric injury in relation to those who witnessed and those who assisted in the rescue of victims involved in the January 2023 Sea World helicopter accident. No findings have been made at the time of writing regarding any possible negligence against any individual or organisation. This article considers, if such a finding is made, whether those culpable might be held legally accountable for psychiatric injury caused as a result.
