Time to abolish the rule in Searle v Wallbank for negligence and nuisance claims

Abstract

Although some jurisdictions have abolished the rule from this case, it applies in other jurisdictions. It continues to limit the ability of a person injured from straying stock from being able to successfully claim against the owner of the animal. This article concludes it is time to totally abolish the rule.
