The Tort of Misuse of Public Office: Suggested Clarifications and Reforms

This paper considers the tort of misuse of public office in light of its (rare) use in a Federal Court decision. It considers the history and rationale for the tort, its development through history, and differences between its contours in the United Kingdom and Australia. It suggests some important reforms to the tort.
