The offence of sedition: Its history, its current status in Australian and international law, and its constitutionality

Abstract

This article focusses on sedition. It is an offence with a lengthy history, and remains a part of our law. It is argued that there may be constitutional issues with provisions that criminalise mere advocacy of views, where there is no incitement to violence.
