Abstract

This article responds to a rejoinder published in response to our article previously published in the Journal of Judicial Administration entitled The Constitutionality of Minimum Mandatory Sentencing. The authors maintain there are serious constitutional questions regarding the validity of minimum mandatory sentencing regimes, given that they arguably impinge on judicial discretion and decision making that is at the heart of the judicial function.
