Strict Liability and the Law of Defamation

Abstract

Liability in defamation has historically been strict, and remains so, subject to defences. However, the trend in tort law has strongly been in favour of fault-based liability. This article considers whether defamation law should be re-conceptualised to make it primarily fault-based.
