Reinvigorating non-delegable duties in Australia?

Abstract

The High Court at one stage favoured the concept of non-delegable duties in the law of tort. However, in more recent cases its use has been more limited. This article considers the current status of non-delegable duties in Australian law, and whether their use should be expanded or abandoned.
