Abstract
This paper argues for a reconsideration of the place of punitive damages in the law of tort. It is an anomalous doctrine, seeking to impose punishment on a tortfeasor. Traditionally, punishment is associated with the criminal law, not the civil law. It can be hard to rationalise it today.
