Abstract
This paper considers legal issues associated with protecting the confidentiality of journalists' sources. While statutes in some jurisdictions provide protections, it is argued that protection might exist under the implied freedom of political communication. Journalists play a pivotal role in the kind of information gathering and sharing inherent in our democracy, and are thus worthy of protection under the constitutional freedom.
