Psychiatric harm claims from observing loved ones killed or injured through medical negligence

Abstract

This article considers the possibility that a person who observes a family member being killed or injured as a result of medical negligence could successfully bring an action against the medical professional for their psychiatric injury. United Kingdom law makes such claims extremely difficult. Australian law differs materially, and it is hoped that, if an Australian court were to hear such a case, it would be more sympathetic to such claims, if negligence and causation could be proven, than has occurred elsewhere.
