Good faith in Australian contract law after Barker

Abstract

This article considers the question of the acceptance of good faith in Australian contract law following the Barker decision. The High Court specifically left open whether the doctrine was part of Australian law. Given sub-national decisions which have different views, it would have been preferable for the High Court to reach a position here.
