Abstract

The article discusses a court case relating to breaches of trust or fiduciary duty of third parties. It presents an analysis of the decision of the High Court of Australia, which favored the plaintiff who was a partner in a joint venture project, on its unjust enrichment claim due to breaches of trust and fiduciary duty. The facts of the case, as well as the revised decision of the New South Wales Court of Appeal, are presented and discussed.
