Abstract

This article examines the current and proposed litigation involving sport-related concussion in Australian sport. It identifies several issues warranting further consideration and reflects upon earlier judicial commentary around the need to appreciate the prevailing scientific knowledge at the relevant time when evaluating foreseeability of the harm of sport-related concussion.
